The fatal incident occurred at 9 p.m. on eastbound state route 78 near Center City parkway. According to the investigation, a white Volvo car struck a bicyclist after trying to pass the right shoulder through the central divider.
Tragically, the bicyclist was found dead at the scene, and the coroner’s office later confirmed that it was 53-year-old Jerry Torres.
Volvo’s 19-year-old driver was slightly injured in the collision.
The officials ruled out intoxication as a factor in the accident. Jerry Torres’ friends and family posted a GoFundeMe page to help pay for the victims’ funeral. At the same time, the Escondido authorities are further investigating the accident.
Who is responsible for bicycle accidents?
Bicyclists suffer serious injuries and deaths in accidents including cars, and Jerry Torres killed in bicycle accidents is almost the driver’s fault. Bicyclists know that car and truck drivers don’t pay enough attention to their surroundings to protect pedestrians and bicyclists.
They do not respect the rights of bicyclists, and in many cases not looking for bicyclists before changing lanes may endanger their lives.
The drivers turn right directly in front of the oncoming bicycle and suddenly open their doors in front of bicyclists, exit driveways, roll stop signs and drive under the influence of alcohol or drugs, similarly through other negligence, the bicyclists are killed or injured.
California State Law gives the same right to use the streets as motorists, but as a bicycle rider, you can argue that point.
