Insurance adjuster in a suit holding a clipboard and inspecting the crushed front end of a silver car parked among other damaged vehicles

An insurance adjuster recorded statement request can arrive within days of a crash, sometimes before you have seen a doctor. After a car accident, you may be surprised by how quickly an insurance adjuster contacts you. Sometimes the call comes while you’re still dealing with vehicle repairs, medical appointments, and the immediate stress of the collision. The adjuster may seem friendly and simply ask you to explain what happened. You may also be asked whether you’re willing to provide a recorded statement about the accident and your injuries.

Before agreeing, it’s important to understand what you’re being asked to provide and why. Our September client education campaign reminds accident victims that they have the right to ask questions before answering an insurance adjuster’s questions. Having legal guidance early in the process may also help you avoid mistakes that could affect your personal injury claim.

What an Insurance Adjuster Recorded Statement Actually Does

Insurance adjusters investigate accidents to evaluate claims for their insurance companies. California sets standards for how insurers must handle those claims, under Insurance Code section 790.03. A recorded statement creates a permanent record of your answers about how the collision happened, what you saw, and the injuries you’re experiencing.

The problem is that immediately after an accident, you may not have all the information.

You may still be shaken by what happened. You may not yet know the full extent of your injuries. You might not have seen the police report, spoken with witnesses, or learned whether surveillance or dashcam footage exists.

Some injuries can also develop or become more noticeable after the initial collision. If you say that you’re “fine” during an early conversation and later begin experiencing significant pain, that earlier statement could potentially become an issue during the claims process.

That’s why it’s important to understand the purpose of a recorded statement before agreeing to one.

Be Careful About Discussing Your Injuries Too Early

One of the most difficult questions to answer immediately after an accident is, “How badly are you hurt?”

The truth may be that you simply don’t know yet.

Whiplash, back injuries, soft-tissue injuries, concussions, and other conditions may not always produce their full symptoms immediately. Adrenaline following a collision can also temporarily mask pain.

Instead of guessing about your condition, prioritize your health. Seek appropriate medical care and follow your doctor’s recommendations. Medical professionals are in a much better position to evaluate your injuries than you are in the hours immediately following a crash.

Your medical records can then help document your diagnosis, treatment, and recovery. That is also why medical appointments after an accident matter to your claim and not only to your health.

You Don’t Have to Navigate the Insurance Process Alone

Insurance claims can become complicated quickly, particularly when serious injuries, disputed liability, multiple vehicles, or significant financial losses are involved. Fault is disputed more often than people expect, even after rear-end collisions in California, and the basics of car accident law and liability in California explain how it is actually decided.

An experienced personal injury attorney can review the circumstances surrounding your accident, help you understand insurance requests, gather evidence, and communicate with insurance companies regarding your claim.
