Parking lots may seem safer than busy streets and freeways because vehicles are traveling at lower speeds, but parking lot accidents happen more often than many people realize. Shopping centers, grocery stores, schools, office complexes, apartment buildings, and entertainment venues can become crowded environments where vehicles, pedestrians, shopping carts, and cyclists are all moving within a relatively small space.
One of the biggest problems is that drivers often let their guard down once they leave the roadway. Even though these collisions frequently occur at relatively low speeds, they can still result in painful and potentially serious injuries.
Why Do Parking Lot Accidents Happen?
Parking lots create unique driving challenges. Vehicles may be backing out simultaneously, pedestrians can appear between parked cars, and drivers may be focused on finding a parking space instead of watching the traffic around them.
Common causes of parking lot accidents include:
- Backing out without checking mirrors and surroundings
- Distracted driving or cellphone use
- Driving too fast through parking aisles
- Failing to yield to pedestrians
- Cutting across parking spaces
- Ignoring stop signs or directional markings
- Limited visibility caused by parked vehicles
- Drivers competing for parking spaces
Pedestrians are particularly vulnerable. A person walking through a parking lot has virtually no protection when struck by a vehicle. Children, older adults, and individuals walking between large SUVs or trucks may also be more difficult for drivers to see.
The safest approach is simple: slow down, eliminate distractions, check carefully before backing up, and assume pedestrians may be nearby.
Who Is Responsible for a Parking Lot Accident?
Determining responsibility after a parking lot collision isn’t always as simple as it appears. Drivers still have a responsibility to operate their vehicles carefully, even on private property. The basics of car accident law and liability in California apply in a parking aisle much the way they apply on the street.
For example, a driver backing out of a parking space should look carefully for vehicles and pedestrians before proceeding, which is what California Vehicle Code section 22106 requires of any driver backing up. At the same time, motorists traveling through parking aisles must remain attentive and drive at a reasonable speed.
Some accidents may involve additional issues, such as poorly maintained parking areas, inadequate lighting, obstructed visibility, or confusing traffic controls. Because every accident is different, determining liability may require reviewing photographs, surveillance footage, witness statements, vehicle damage, and other available evidence.
What Should You Do After a Parking Lot Accident?
Treat a parking lot collision seriously, even when the vehicle damage appears minor. If you’ve been injured, seek medical attention and document the incident as thoroughly as possible. Low speed does not mean low cost, and who will pay your medical bills after an accident is worth understanding early.
If you’re able, consider taking photographs of the vehicles, their positions, surrounding signs and markings, and any visible injuries. Exchange insurance information with the other driver and obtain contact information from witnesses.
You should also determine whether nearby businesses or properties have surveillance cameras. Video footage can sometimes provide valuable evidence showing how an accident occurred, but that footage may not be retained indefinitely.
