Reporting a workplace injury is the step most people put off, and the one that matters soonest. A workplace injury can happen in seconds. You may slip on a warehouse floor, hurt your back lifting equipment, fall from a ladder at a construction site, or suffer an injury while performing the same job you’ve done hundreds of times before. When an accident happens at work, one of the most important things you can do is report the injury as soon as possible.

Many employees make the mistake of waiting because they believe the injury will improve on its own or they don’t want to create problems at work. Others may finish their shift before realizing how badly they’ve been hurt. However, delays can complicate a workers’ compensation claim. Our September campaign encourages injured workers to report an injury promptly, seek medical care, document what happened, and learn about their legal rights.

Why Promptly Reporting a Workplace Injury Matters

After a workplace accident, your employer needs to know that an injury occurred. Reporting what happened creates an important record connecting your injury to your employment and allows the workers’ compensation process to begin. California generally expects that notice within thirty days of the injury, under Labor Code section 5400.

Waiting can create unnecessary questions later. If days or weeks pass before an injury is reported, there may be disputes about when the injury occurred, whether it happened at work, or whether something else caused the medical condition.

That doesn’t mean every workplace injury is immediately obvious. Some injuries develop gradually or become more painful after a shift ends. Repetitive motion injuries may also develop over time rather than from one specific accident. Regardless of how an injury occurs, employees should take workplace injuries seriously and learn what steps apply to their particular circumstances. It helps to know the most common causes of accidents at work and how they tend to be reported.

What Should You Do After Being Injured at Work?

Your health should always come first. If you need emergency medical treatment, seek it immediately.

You should also report the injury to your employer or supervisor as soon as possible and explain what happened. Be accurate and consistent when describing the incident and your symptoms.

Documentation can also become important. Keep records related to:

  • When and where the injury occurred
  • How the accident happened
  • Names of witnesses
  • Medical appointments
  • Treatment recommendations
  • Work restrictions
  • Time missed from work
  • Communications regarding the injury

If photographs can safely document the location, equipment, or condition involved in your accident, those images may also be useful.

Most importantly, follow your medical provider’s instructions and attend scheduled appointments. Your recovery should remain the priority.

Workers’ Compensation May Not Be the Only Issue

Workers’ compensation is designed to provide certain benefits to eligible employees who suffer job-related injuries or illnesses. However, workplace accidents can sometimes involve additional legal issues.

For example, a construction worker might suffer a serious workplace injury because of equipment supplied by another company, the actions of a subcontractor, or another potentially responsible third party. Situations involving multiple companies or parties can become more complicated than a routine workers’ compensation claim.

That is why understanding the specific circumstances surrounding your accident is important. An attorney can evaluate what happened and help explain which legal options may apply. Our verdicts and settlements show how those claims are approached.
