Start by Telling Us What Happened

You don’t need to understand legal terminology before speaking with a personal injury attorney.

Start with what you know.

Explain when and where the incident happened, who was involved, what you remember, what injuries you’re experiencing, and what has happened since.

If you’ve received medical treatment, been contacted by insurance companies, missed work, or collected photographs and other documents, that information may also be relevant.

The purpose of the conversation is to better understand the circumstances.

Ask Questions

A consultation isn’t supposed to be a one-way conversation.

You should have an opportunity to ask questions.

You may want to understand how the personal injury process works, what information may be important, what happens if an insurance company contacts you, or what the next steps could look like.

Every situation is different, so answers will depend on the particular facts involved.

What to Bring, If You Have It

Nothing on this list is required in order to have a conversation, and a missing document is not a reason to put the call off. If you already have any of it, bring it:

  • The police or incident report, or just the report number
  • Photographs and video from the scene
  • Names and phone numbers of any witnesses
  • The name of every provider who has treated you so far
  • Anything an insurance company has sent you, including letters and claim numbers
  • Pay records, or simply a note of the work you have missed

If you have already given a recorded statement to an insurance company, say so early. It changes what the conversation needs to cover.

What a Free Consultation Costs

Cost comes up in most first calls, so it is worth stating plainly. The consultation is free, and personal injury matters are handled on a contingency fee. That means no upfront charge, and no attorney fee unless there is a recovery.

The other question worth answering up front is when to call. Sooner is better, and not for the reason people assume. It is not about the filing deadline, which under Code of Civil Procedure section 335.1 is generally two years for a California personal injury claim. It is that surveillance footage gets overwritten, witnesses move, and vehicles are repaired or scrapped, often within the first few weeks.

Understanding the Next Steps

After learning more about your circumstances, an attorney can discuss whether the firm may be able to assist and what could happen next.

If representation begins, additional steps may include investigating the incident, gathering evidence, obtaining relevant records, communicating with insurance companies, and evaluating how the injury has affected you.

Most importantly, you should understand what you’re agreeing to before hiring an attorney.
